Report Disclaimers and Limitations

Aelin produces reports containing analysis of information provided by or on behalf of the subject company, or provided by a third party about the company (“Subject Information”). By acceptance and use of an Aelin report, you are agreeing to the following disclaimers and limitations on liability. 

The information, materials and analysis contained in the reports are for general information purposes only, are not intended to constitute legal or other professional advice and should not be relied on or treated as a substitute for specific advice relevant to particular circumstances. Each report is generated as of a particular date using Subject Information provided as of that date, and Aelin makes no representations, warranties or guarantees, whether express or implied, that the content of such report is accurate, complete or up-to-date. Any action you take based on the content of any Aelin report is taken entirely at your own risk.  You should seek all additional information from or regarding the subject company you need to make an informed judgment prior to making any financial or investment decision regarding the subject company.

Although Aelin generates reports using Subject Information from sources believed to be reliable, Aelin shall not be held liable or responsible for the content of any report and makes no warranty expressed or implied regarding accuracy, adequacy, completeness, legality, reliability or usefulness of any information contained therein. This disclaimer applies to both isolated and aggregate uses of the information. Each report is provided on an "AS IS" basis. All warranties of any kind, express or implied, including but not limited to the IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM CONTAMINATION BY COMPUTER VIRUSES AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE DISCLAIMED. We make no other warranties, representations, or undertakings about any of the content of any report (including, without limitation, any as to the quality, accuracy, or completeness of such content). 

Subject Information may periodically change, which changes may or may not be incorporated in any given report. You must be aware that both hard-copy and electronic reports can be altered subsequent to original the generation date. Data can also quickly become out-of-date. It is recommended that the you pay careful attention to the contents of any metadata associated with a file, the generation date noted on a given report, and that Aelin, the subject company, or owner of the Subject Information be contacted with any questions regarding appropriate use. If you find any errors or omissions, we encourage you to report them to Aelin or the subject company.

Aelin shall not be held liable or responsible for any improper or incorrect use of the information described and/or contained in a report and assumes no responsibility for anyone's use of the report or the information or analysis therein. In no event shall Aelin or any of its affiliates be liable for any direct, indirect, incidental, special, exemplary, or consequential damages however caused and on any theory of liability, whether in contract, strict liability, tort (including negligence or otherwise), or any other theory arising in any way out of the use of this system, even if advised of the possibility of such damage. This disclaimer of liability applies to any damages or injury, whether based on alleged breach of contract, tortious behavior, negligence or any other cause of action, including but not limited to damages or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, and/or theft, destruction or unauthorized access to, alteration of, or use of any record.

By accepting and using an Aelin report, you agree to defend, indemnify, and hold harmless, Aelin and its affiliates and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of the report, including the information and analysis contained therein.

All information, images, analysis and content contained in the report is the property of Aelin or the subject company, as appropriate.  Unless otherwise agreed in writing by Aelin, you are not authorized to collect, aggregate, deconstruct, copy, reproduce, or duplicate any Aelin report or the information contained therein, but to the extent that any copy of a report is produced, you agree that any such copy shall retain all copyright and other proprietary notices that may be contained therein or apply thereto. Nothing contained herein shall be construed as conferring by implication or otherwise any license or right under any patent, copyright or trademark of the Aelin or any third party. 

Although Aelin strives for accuracy in its reports, any publication may contain inaccuracies or typographical errors. Changes, corrections and improvements may be made periodically to these reports, and will be incorporated in new versions of these reports. Either Aelin or the subject company may make changes, corrections and/or improvements in its reports, and/or the information or analysis contained in those reports, at any time without notice. Aelin reports may not present financial information in accordance with generally accepted accounting principals.

Construction of the disclaimers above and resolution of disputes thereof are governed by the laws of the State of Colorado.
